Important Notice: Current Pilot Pre-Launch (Australia Only)

As at the date of these Terms, JLever Espresso is accepting pre-orders for the JLeverX as part of a 100-unit pilot production run. The pilot is offered to customers in Australia only and is sold through this Website as a pre-order.

During the pilot pre-launch:

  • Australia only: we sell and ship to Australian addresses only. These Terms do not cover crowdfunding campaigns or sales outside Australia; separate terms will be published before any such campaign or sales begin.
  • Currency and tax: prices are shown and charged in Australian Dollars and include Australian GST where applicable.
  • Pre-orders: Section 7 sets out when you are charged, when we expect to dispatch, and your right to cancel for a full refund at any time before dispatch.
  • Priority handling for replacement parts (pilot best-efforts service): during the warranty periods set out in Section 11, where you are entitled to a replacement part under Section 3 of the Returns, Refunds & Warranty Policy, we will treat your request as a priority and will cover the cost of standard tracked shipping within Australia. Dispatch times depend on part availability and may be longer where a part is out of stock or requires a further production run. We will communicate expected timelines on a case-by-case basis. This is a best-efforts service in addition to, and does not limit, your rights under Section 11 of these Terms or under the Australian Consumer Law. It does not create any guaranteed dispatch or delivery timeframe.

1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of the website located at jleverespresso.com ("Website") and any related products and services offered by JLever Espresso Pty. Ltd. ACN 686 602 817 ("JLever Espresso", "we", "us", or "our").

By accessing our Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.

These Terms apply to Orders placed through our Website for delivery in Australia. We do not currently sell or ship outside Australia (see Section 8).

We may update these Terms from time to time. Material changes will be communicated by updating the "Last Updated" date above and, where appropriate, by notice on our Website or by email. The Terms that apply to an Order are those in force when you place it; later changes do not apply to Orders you have already placed. For your use of our Website itself, the updated Terms apply from the date they are posted.

2. Definitions

  • "Customer" means a person who places an order through our Website;
  • "You" means any visitor or Customer;
  • "Products" means the goods we offer for sale, including coffee equipment, accessories, and related items;
  • "Order" means your request to purchase Products through our Website;
  • "Pre-order" means an Order for a Product that is offered on our Website as a pre-order, to be dispatched at a later date.

3. Eligibility and Accounts

To place an Order or create an account with us, you must be at least 18 years of age and capable of entering into a legally binding contract under the laws of your jurisdiction.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

We may suspend or close an account in the circumstances set out in Section 17.

4. Products, Pricing, and Availability

We take reasonable care to ensure that product descriptions, images, and specifications on our Website are accurate. Minor variations (for example in colour, finish, or packaging) may occur. If, before your Order is dispatched, we find an error in a description that affects it, we will tell you and you may cancel the Order for a full refund. Nothing in this Section affects your rights under the Australian Consumer Law, including the guarantee that Products match their description.

Prices are shown and charged in Australian Dollars and include Australian GST where applicable. Prices do not include shipping, which is calculated and displayed at checkout before you complete your Order (see Section 8).

We may change our prices, and may modify, limit, or discontinue Products, at any time, but these changes do not affect Orders we have already accepted. If we discover a genuine pricing error after you have placed an Order, we will contact you before shipping and offer you the option to proceed at the corrected price or cancel the Order for a full refund.

5. Orders and Contract Formation

Your submission of an Order through our Website is an offer to purchase the Products at the listed price, subject to these Terms. We accept your Order, and a contract is formed, when we send you an email confirming your Order.

We may decline an Order before we confirm it, for example where:

  • The Product is out of stock or no longer available;
  • There has been a pricing or description error;
  • We cannot authorise your payment;
  • We suspect the Order is fraudulent;
  • The delivery address is outside Australia (see Section 8).

If we decline your Order, we will notify you promptly and refund in full any payment already taken.

6. Payment

We accept payment through Stripe, PayPal, and other payment processors enabled on our Website from time to time. Payment is taken at the time you place your Order, including for Pre-orders (see Section 7).

You warrant that the payment details you provide are valid, accurate, and that you are authorised to use the payment method. We do not store full payment card details — these are handled directly by our payment processors in accordance with their own security standards.

7. Pre-Orders

Some Products, including the JLeverX during the pilot pre-launch, are offered for pre-order. This Section applies to every Pre-order, in addition to the rest of these Terms.

  • Payment: you are charged the full price, plus any shipping charge shown at checkout, when you place your Pre-order.
  • Estimated dispatch date: the product page shows the date we expect to dispatch Pre-orders. The date shown when you place your Pre-order is our genuine estimate, based on our production and freight schedule at that time. It is a dispatch date, not a delivery date; delivery after dispatch is covered in Section 8.
  • If the date changes: if we expect to dispatch your Pre-order later than the date shown when you ordered, we will email you promptly with a revised date and a reminder of your right to cancel.
  • Your right to cancel: you may cancel a Pre-order for any reason, at any time before we dispatch it, by emailing info@jleverespresso.com with your order number. We will refund everything you paid for the Pre-order, including shipping, to your original payment method. We process these refunds within 10 business days of your request; your bank or payment provider may take a further 3-10 business days to show the refund.
  • If we cannot supply: if, despite taking reasonable steps, we are unable to supply your Pre-order (for example, because a production or quality problem prevents us from completing the pilot run), we will tell you promptly and refund everything you paid for it, including shipping.
  • After dispatch: once your Pre-order has been dispatched, our Returns, Refunds & Warranty Policy applies in the same way as for any other Order, including the 30-day satisfaction trial from the date of delivery.

Nothing in this Section limits your rights under the Australian Consumer Law, including your rights if we do not supply a Product within the time we have stated or within a reasonable time.

8. Shipping, Delivery, and Risk

We ship to addresses in Australia only, using Australia Post and other carriers. Shipping costs are calculated based on the weight of the Products and the destination, and are displayed at checkout before you complete your Order.

Delivery times shown on our Website or at checkout are estimates. Actual delivery may vary due to factors outside our control, including carrier delays, weather, and public holidays. If your Order has not arrived within a reasonable time after dispatch, contact us and we will follow it up with the carrier. If it cannot be located, we will send a replacement or, if you prefer or we cannot replace it promptly, give you a full refund including shipping. Dispatch timing for Pre-orders is covered in Section 7.

Risk in the Products passes to you when the Products are delivered to you or to the shipping address you gave us. You are responsible for providing an accurate and complete shipping address. If a parcel is returned to us because the address you gave us was incorrect or incomplete, we may ask you to pay the reasonable cost of sending it again. If a parcel is delivered to the address you gave us, it has been delivered even if that address was wrong; we will help you try to recover it, but we are not responsible for replacing it.

If your Order arrives damaged, or is not what you ordered, see Section 3 of our Returns, Refunds & Warranty Policy.

9. User-Generated Content

If you submit content to our Website (including product reviews, questions, comments, or photos), you grant JLever Espresso a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, adapt, publish, and display that content in connection with our Website, marketing, and related business activities.

You warrant that any content you submit:

  • Is your own original work or you have permission to submit it;
  • Is accurate and reflects your genuine opinion or experience;
  • Does not infringe any third party's rights;
  • Does not contain defamatory, unlawful, or otherwise prohibited material.

Your use of our Website and submission of content is also governed by our Acceptable Use Policy. We reserve the right to remove any content at our discretion.

10. Returns, Refunds, and Australian Consumer Law

Our full Returns, Refunds & Warranty Policy describes the circumstances in which you may return Products and the process for doing so. For Products purchased directly through our Website, the Policy includes a 30-day satisfaction trial (which accepts used returns subject to a tiered restocking fee).

Australian Consumer Law guarantees: if you are a consumer as defined under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our Products come with guarantees that cannot be excluded. These include guarantees that the Products will be of acceptable quality, fit for purpose, match their description, and be supplied with due care and skill.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law or any equivalent consumer protection legislation in your jurisdiction that cannot be lawfully excluded or modified.

11. Limited Manufacturer Warranty

In addition to your rights under the Australian Consumer Law, JLever Espresso provides the following limited manufacturer warranty against defects in materials and workmanship under normal domestic use, beginning on the date of delivery to the original purchaser. Full warranty terms - including what is covered, what is not covered, and how to make a claim - are set out in Section 4 of our Returns, Refunds & Warranty Policy.

The benefits of this warranty are in addition to other rights and remedies you have under a law in relation to the Products, including the consumer guarantees described in Section 10. To make a claim, contact us using the details in Section 21. Where a defect is covered we will, at our option, repair the part, supply a replacement part, or replace the Product. We pay outbound shipping on warranty parts and replacements. If a Product must be returned to us, you pay the return postage; if we confirm a fault, email us the receipt and we will reimburse your reasonable postage.

Summary of warranty periods:

  • Non-consumables - 5 years: aluminium base, cylinder body (which forms the water chamber), piston, baskets, and basket tops;
  • Hard consumables - 2 years: bearings, arms, shafts, silicone covers, and other moving or mechanically loaded parts;
  • Consumables - 6 months: springs, silicone gaskets and O-rings, and puck metal retainer plates;
  • Accessories - 3 years: magnetic funnel, tamper, adjustable volumetric scoop, WDT tool, and Allen key. WDT needles are not warranted against bending or deformation;
  • Disposables - not warranted: paper filters and other single-use items.

The warranty is offered to the original purchaser only and is not transferable. The warranty does not cover normal wear and tear, accidental damage, misuse, damage from water outside recommended specifications, unauthorised modification or repair, cosmetic wear, commercial use, or bending of WDT needles. See the Returns, Refunds & Warranty Policy for the full list of exclusions and the claims process.

12. Intellectual Property

All content on our Website — including text, graphics, logos, images, product designs, photographs, and software — is owned by or licensed to JLever Espresso and is protected by Australian and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to access and view our Website for personal, non-commercial use. Except as expressly permitted, you may not:

  • Copy, reproduce, distribute, or republish any content from our Website;
  • Modify, adapt, or create derivative works from our content;
  • Use our trademarks, logos, or branding without written permission;
  • Decompile, reverse engineer, or attempt to extract source code from any software on our Website;
  • Use our content for any commercial purpose without our prior written consent.

13. Prohibited Use

You must not use our Website or services to:

  • Breach any applicable law, regulation, or third-party right;
  • Transmit unsolicited commercial communications (spam);
  • Interfere with or disrupt the operation of our Website or any associated network;
  • Attempt to gain unauthorised access to our systems, user accounts, or data;
  • Collect or harvest personal information about other users without their consent;
  • Impersonate JLever Espresso or any other person or entity;
  • Engage in fraudulent activity of any kind.

Further restrictions are set out in our Acceptable Use Policy, which forms part of these Terms.

14. Third-Party Links

Our Website may contain links to third-party websites or services. We do not control these third parties and are not responsible for their content, policies, or practices. Links are provided for convenience only, and their inclusion does not imply endorsement. Your use of any third-party website is at your own risk.

15. Disclaimers and Limitation of Liability

Your consumer rights come first: Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified. This includes your rights to a repair, replacement, or refund, and to compensation for reasonably foreseeable loss or damage, where a Product does not meet a consumer guarantee. Our Products are also covered by the Limited Manufacturer Warranty in Section 11.

Our Website: We provide our Website on an "as is" and "as available" basis. To the extent permitted by law, we do not promise that our Website will always be available, uninterrupted, or free of errors. This does not affect what we tell you about our Products (see Section 4).

Other loss: Subject to the first paragraph of this Section, and to the extent permitted by law, JLever Espresso is not liable for:

  • Loss or damage that was not reasonably foreseeable;
  • Loss or damage to the extent it was caused by your breach of these Terms, or by use of a Product contrary to its instructions or warnings;
  • Loss of profit, revenue, business opportunity, goodwill, or reputation arising from commercial use of a Product, as our Products are designed and sold for domestic use;
  • Loss of data or interruption of service arising from your use of our Website.

16. Indemnity

If you breach these Terms, misuse our Website, or infringe someone else's rights through content you submit, and we suffer loss as a direct result, you agree to compensate us for that loss (including reasonable legal costs). This does not apply to the extent that we caused or contributed to the loss, or could reasonably have avoided or reduced it.

17. Termination

We may suspend or terminate your access to our Website, or close your account, if you seriously breach these Terms, or if we reasonably believe your use of our Website poses a risk to us or other users.

We may cancel an Order we have accepted only where: (a) we reasonably suspect fraud or an unauthorised payment; (b) despite taking reasonable steps, we are unable to supply the Product (see Sections 7 and 18); (c) there was a genuine pricing or description error and you do not wish to proceed on the corrected basis (see Section 4); (d) the delivery address is outside Australia; or (e) you have seriously breached these Terms in connection with that Order. If we cancel an Order, we will refund in full everything you paid for the Products we have not delivered, including shipping.

Termination does not affect any rights or liabilities that have accrued before termination, nor any provisions of these Terms that by their nature are intended to survive termination (including intellectual property, indemnity, liability limitations, and governing law).

18. Force Majeure

If an event beyond our reasonable control (for example a natural disaster, pandemic, war, act of terrorism, government action, labour dispute, or a supply chain or freight disruption that we could not reasonably have prevented or worked around) delays or prevents us from performing an obligation under these Terms, we are not in breach of these Terms because of that delay or failure while the event continues, provided we tell you as soon as we reasonably can and take reasonable steps to limit its effect.

If such an event delays your Order, you may cancel any Order (including a Pre-order) that has not been dispatched and receive a full refund. This Section does not excuse us from refunding you for Products you do not receive, does not affect Section 8 (parcels that are lost or damaged before delivery), and does not limit your rights under the Australian Consumer Law.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You and JLever Espresso submit to the non-exclusive jurisdiction of the courts of Victoria, Australia, and the courts competent to hear appeals from those courts, for any dispute arising out of or in connection with these Terms.

Nothing in this Section prevents you from bringing a claim in a court or tribunal of the Australian State or Territory in which you live, or limits any rights you have under consumer protection laws that apply there.

20. General Provisions

Your contract with us: Your contract with us for an Order is made up of these Terms, our Privacy Policy, Cookie Policy, Returns, Refunds & Warranty Policy, and Acceptable Use Policy, together with the product page as it appeared when you placed your Order (including the price, description, and any estimated dispatch date), your order confirmation, and any warranty document supplied with the Product. Nothing in these Terms excludes our responsibility for statements we made to you before you placed your Order.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a sale, merger, or transfer of our business, provided your rights under these Terms and any Order you have placed are not adversely affected.
