1. About These Terms
These Terms of Service ("Terms") govern your access to and use of the website located at jleverespresso.com ("Website") and any related products, services, and campaigns offered by JLever Espresso Pty. Ltd. ACN 686 602 817 ("JLever Espresso", "we", "us", or "our").
By accessing our Website, placing an order, or backing one of our crowdfunding campaigns (including on Kickstarter or Indiegogo), you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.
We may update these Terms from time to time. Material changes will be communicated by updating the "Last Updated" date above and, where appropriate, by notice on our Website or by email. Your continued use of our Website after changes take effect constitutes acceptance of the revised Terms.
2. Definitions
- "Backer" means a person who pledges to one of our crowdfunding campaigns on Kickstarter, Indiegogo, or a similar platform;
- "Customer" means a person who places an order through our Website;
- "You" means any visitor, Customer, or Backer;
- "Products" means the goods we offer for sale or as crowdfunding rewards, including coffee equipment, accessories, and related items;
- "Order" means your request to purchase Products through our Website;
- "Pledge" means a contribution made to one of our crowdfunding campaigns in exchange for a reward.
3. Eligibility and Accounts
To place an Order or create an account with us, you must be at least 18 years of age and capable of entering into a legally binding contract under the laws of your jurisdiction.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.
We reserve the right to suspend or terminate any account at our discretion, including where we reasonably believe the account has been used in breach of these Terms or for fraudulent purposes.
4. Products, Pricing, and Availability
We take reasonable care to ensure that product descriptions, images, and specifications on our Website are accurate. However, minor variations may occur, and we do not warrant that descriptions or other content are completely accurate, current, or error-free.
Prices displayed on our Website are shown in the currency selected (including Australian Dollars, US Dollars, Euros, British Pounds, and others where available). The currency and price at the time you complete checkout will apply to your Order. Currency conversions, where shown, are approximate and the final amount charged may vary slightly depending on your card issuer or payment provider's exchange rate.
Prices do not include shipping, import duties, customs fees, or taxes imposed by your destination country, which are your responsibility (see Section 7).
We reserve the right to correct pricing errors and to modify, limit, or discontinue Products at any time without notice. If we discover a pricing error after you have placed an Order, we will contact you before shipping and offer you the option to proceed at the corrected price or cancel the Order for a full refund.
5. Orders and Contract Formation
Your submission of an Order through our Website is an offer to purchase the Products at the listed price, subject to these Terms. An Order is not accepted, and no contract is formed, until we send you a confirmation email stating that your Order has been accepted.
We reserve the right to decline any Order at our discretion, including (without limitation) where:
- The Product is out of stock or no longer available;
- There has been a pricing or description error;
- We cannot authorise your payment;
- We suspect the Order is fraudulent;
- The destination is a country we do not ship to (see Section 8).
If we decline your Order, we will notify you and refund any payment already taken.
6. Payment
We accept payment through Stripe, PayPal, and other payment processors enabled on our Website from time to time. Payment is taken at the time you place your Order.
You warrant that the payment details you provide are valid, accurate, and that you are authorised to use the payment method. We do not store full payment card details — these are handled directly by our payment processors in accordance with their own security standards.
For crowdfunding Pledges, payment is processed by the relevant platform (Kickstarter or Indiegogo) according to their terms. We do not receive funds from those platforms until after their processing and payout schedules.
7. Shipping, Delivery, and Risk
We ship internationally using Australia Post and other national and international shipping and logistics providers. Shipping costs are calculated based on the weight of the Products and the destination, and are displayed at checkout before you complete your Order.
Estimated delivery times are provided for guidance only and are not guaranteed. Actual delivery may vary due to factors outside our control, including carrier delays, weather, customs inspections, and public holidays.
Risk in the Products passes to you when the Products are delivered to the carrier for shipment to you. You are responsible for providing an accurate and complete shipping address. We are not liable for losses resulting from incorrect or incomplete address information.
Import duties, customs fees, and taxes: all Products are shipped on a Delivered Duty Unpaid (DDU) basis. Import duties, customs clearance fees, goods and services taxes, value-added taxes, and any other charges imposed by the destination country are your responsibility and are payable by you upon import. We have no control over these charges and cannot predict their amount. If you refuse to pay applicable duties and the Products are returned to us or destroyed, you will not be entitled to a refund of shipping or duty-recovery costs.
8. Countries We Ship To
We ship to most countries worldwide. However, we do not ship to destinations where delivery is prohibited or restricted by applicable laws, including (without limitation) economic sanctions and export control regulations imposed by Australia, the United Nations, the European Union, the United Kingdom, or the United States.
We also reserve the right to decline shipment to specific destinations where we determine, in our reasonable discretion, that reliable delivery cannot be achieved or where shipping costs are commercially unviable. The list of countries we currently ship to is available at checkout. If your destination is not listed, please contact us before placing an Order.
9. Crowdfunding Campaigns (Kickstarter and Indiegogo)
From time to time, we run crowdfunding campaigns on platforms such as Kickstarter and Indiegogo. These campaigns are governed by the terms and conditions of the relevant platform as well as by these Terms. Where there is a conflict, the platform's terms will apply to the Pledge transaction itself, and these Terms will apply to the underlying relationship between you and JLever Espresso.
9.1 Nature of a Pledge
A Pledge is a contribution to our campaign in exchange for a reward. Crowdfunding involves inherent uncertainty — including risks relating to product development, manufacturing, supply chain, shipping, and regulatory approval.
By making a Pledge, you acknowledge that:
- The Product you are pledging for may be in development, pre-production, or subject to design iteration;
- Estimated delivery dates are good-faith estimates only and may be subject to delay;
- Crowdfunding campaigns carry risks that do not apply to completed, in-stock Products;
- Backer benefits and rewards are not guaranteed in the same way as a completed retail sale.
We commit to making reasonable, good-faith efforts to deliver the rewards you pledged for, to communicate transparently about progress and setbacks, and to refund Pledges in circumstances described below.
9.2 Estimated Delivery Dates
We will communicate an estimated delivery date for each reward tier during the campaign. These dates are estimates, not guarantees. Manufacturing, quality assurance, certification, shipping, and unforeseen challenges may cause delays. If significant delays occur, we will provide updates through the campaign platform and by email.
9.3 Pledge Cancellation and Refunds
You may cancel your Pledge and request a full refund at any time before your reward has shipped. To cancel:
- During an active campaign, cancel your Pledge through the Kickstarter or Indiegogo platform directly;
- After the campaign has ended but before shipping, contact us at info@jleverespresso.com with your Pledge details and we will process your refund.
Once your reward has been shipped, standard Australian Consumer Law rights and our Returns Policy apply (see Section 11).
9.4 Additional Charges for Backers
In some cases, additional charges may apply after the main Pledge (for example, shipping fees, add-ons, late pledges, or upgrades). Where this is the case, we will communicate clearly in the campaign materials or via a separate backer-management portal. No additional charges will be taken without your authorisation.
10. User-Generated Content
If you submit content to our Website (including product reviews, questions, comments, or photos), you grant JLever Espresso a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, adapt, publish, and display that content in connection with our Website, marketing, and related business activities.
You warrant that any content you submit:
- Is your own original work or you have permission to submit it;
- Is accurate and reflects your genuine opinion or experience;
- Does not infringe any third party's rights;
- Does not contain defamatory, unlawful, or otherwise prohibited material.
Your use of our Website and submission of content is also governed by our Acceptable Use Policy. We reserve the right to remove any content at our discretion.
11. Returns, Refunds, and Australian Consumer Law
Our full Returns Policy describes the circumstances in which you may return Products, and the process for doing so.
Australian Consumer Law guarantees: if you are a consumer as defined under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our Products come with guarantees that cannot be excluded. These include guarantees that the Products will be of acceptable quality, fit for purpose, match their description, and be supplied with due care and skill. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage.
Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law or any equivalent consumer protection legislation in your jurisdiction that cannot be lawfully excluded or modified.
12. Intellectual Property
All content on our Website — including text, graphics, logos, images, product designs, photographs, and software — is owned by or licensed to JLever Espresso and is protected by Australian and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable licence to access and view our Website for personal, non-commercial use. Except as expressly permitted, you may not:
- Copy, reproduce, distribute, or republish any content from our Website;
- Modify, adapt, or create derivative works from our content;
- Use our trademarks, logos, or branding without written permission;
- Decompile, reverse engineer, or attempt to extract source code from any software on our Website;
- Use our content for any commercial purpose without our prior written consent.
13. Prohibited Use
You must not use our Website or services to:
- Breach any applicable law, regulation, or third-party right;
- Transmit unsolicited commercial communications (spam);
- Interfere with or disrupt the operation of our Website or any associated network;
- Attempt to gain unauthorised access to our systems, user accounts, or data;
- Collect or harvest personal information about other users without their consent;
- Impersonate JLever Espresso or any other person or entity;
- Engage in fraudulent activity of any kind.

14. Third-Party Links
Our Website may contain links to third-party websites or services. We do not control these third parties and are not responsible for their content, policies, or practices. Links are provided for convenience only, and their inclusion does not imply endorsement. Your use of any third-party website is at your own risk.
15. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, and subject always to the consumer guarantees under the Australian Consumer Law (and equivalent laws in your jurisdiction), our Website and Products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, JLever Espresso and its directors, officers, employees, and suppliers will not be liable for any indirect, consequential, incidental, special, or exemplary loss or damage arising out of or in connection with your use of our Website, the purchase or use of our Products, or participation in any crowdfunding campaign, including (without limitation):
- Loss of profit, revenue, or business opportunity;
- Loss of goodwill or reputation;
- Loss of data or interruption of service;
- Delay in delivery beyond our reasonable control.
Where liability cannot be excluded, it is limited (to the extent permitted by law) to the amount paid by you for the relevant Products or, at our option, re-supplying the Products or providing a refund.
Nothing in this section limits any right or remedy you may have under the Australian Consumer Law or equivalent laws in your jurisdiction that cannot be lawfully excluded.
16. Indemnity
You agree to indemnify and hold JLever Espresso harmless from any claims, losses, liabilities, damages, and expenses (including reasonable legal costs) arising out of or in connection with your breach of these Terms, your misuse of our Website or Products, or your violation of any applicable law or third-party right.
17. Termination
We may suspend or terminate your access to our Website, close your account, or cancel outstanding Orders at our discretion if you breach these Terms, or if we reasonably believe your use of our Website poses a risk to us or other users.
Termination does not affect any rights or liabilities that have accrued before termination, nor any provisions of these Terms that by their nature are intended to survive termination (including intellectual property, indemnity, liability limitations, and governing law).
18. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by events beyond our reasonable control, including (without limitation) natural disasters, pandemics, war, acts of terrorism, government action, labour disputes, supply chain disruptions, or failures of third-party providers.
19. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You and JLever Espresso irrevocably submit to the exclusive jurisdiction of the courts of Victoria, Australia, and the courts competent to hear appeals from those courts, for any dispute arising out of or in connection with these Terms.
If you are a consumer resident outside Australia, you may also have rights to bring proceedings in the courts of your country of residence under mandatory local consumer protection laws.
20. General Provisions
Entire agreement: These Terms, together with our Privacy Policy, Cookie Policy, Returns Policy, and Acceptable Use Policy, constitute the entire agreement between you and JLever Espresso regarding your use of our Website and purchase of our Products.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
No waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a sale, merger, or transfer of our business.
